Terms and Conditions

Last updated: September 2026

OVERVIEW

Welcome to anornament. The terms "we", "us" and "our" refer to anornament, a sole trader business established and operating in England. anornament operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). anornament is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referred to within them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as our liability to you and the basis on which our products are sold.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms of Service affects your statutory rights as a consumer, which cannot be excluded or limited by agreement.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age. If you permit a minor in your care to use the Services on a device you own or manage, you accept responsibility for that use.

To use the Services, including browsing our online store or purchasing any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and delivery details. You confirm that the information you provide is correct, current and complete, and that you have all rights necessary to provide it. We cannot accept responsibility for orders that are delayed or misdelivered as a result of details entered incorrectly.

You are responsible for maintaining the security of your account credentials and for activity carried out under your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 - OUR PRODUCTS

Every piece we sell is carved from natural wood or cast in resin and then painted individually. No two pieces are exactly alike. Variation in grain, knots, brushwork, tone and exact dimensions is an inherent characteristic of the work and is not a defect. The photographs in our store show representative examples rather than the specific piece you will receive.

Colours and appearance may also differ from how they appear on your screen, depending on the device you use and its settings and configuration.

All product descriptions are subject to change at any time at our discretion. We reserve the right to discontinue any product at any time, and to limit the quantities of any product we offer to any person, geographic region or jurisdiction, on a case by case basis.

Our products are decorative items intended for adults and for display. They are not toys. Some pieces contain small parts or fine detail and should be kept away from young children and animals.

Nothing in this section affects your legal rights in relation to products that are faulty, not as described, or not of satisfactory quality.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. anornament reserves the right to accept or decline your order at its discretion. Your order is not accepted until anornament confirms acceptance. We must receive and process your payment before your order is accepted.

Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order has been accepted and, in the case of made-to-order pieces, once work has begun.

If we do not accept, change, or cancel an order, we will attempt to notify you using the email address or other contact details provided at the time the order was placed, and we will refund in full any payment taken.

Your purchases are subject to return, cancellation or exchange in accordance with our Returns & Refunds policy, which forms part of these Terms.

Our products are sold for your own personal or household use, or as gifts, and not for commercial resale.

SECTION 4 - PERSONALISED AND MADE-TO-ORDER PRODUCTS

Certain products are produced individually to your specification, including named ornaments and keychains, custom charms, and commissioned pieces. Because such products are made to your requirements, they cannot be resold or remade for any other customer.

You are responsible for the accuracy of the details you supply, including spelling, names and any custom specification. You will be asked to confirm these details at checkout, and we will send you written confirmation by email of exactly what is to be produced before work begins. Once you approve that confirmation, work commences and the order cannot be cancelled or amended.

For this reason, personalised and made-to-order products are exempt from the right to cancel that would otherwise apply to a distance purchase, and cannot be returned or refunded on the basis of a change of mind.

This does not affect your rights where a personalised product arrives damaged, is not of satisfactory quality, or does not correspond to the specification you approved. Such cases are covered by our Returns & Refunds policy.

We reserve the right to decline any personalisation request that is offensive, unlawful, infringes the intellectual property rights of a third party, or that we otherwise consider unsuitable. Where we decline such a request, we will refund you in full.

SECTION 5 - PRICES AND PAYMENT

Prices are displayed in pounds sterling. The price charged for a product will be the price in effect at the time the order is placed, as set out in your order confirmation email.

anornament is not currently registered for VAT, and accordingly no VAT is charged on our prices. Delivery charges are shown separately at checkout before payment is taken.

Where an order is delivered outside the United Kingdom, any customs duties, import taxes or handling charges levied in the destination country are payable by you and are separate from the amounts paid to us.

Prices, discounts and promotions are subject to change without notice, although changes will not affect an order we have already accepted. We may from time to time run promotions governed by terms separate from these Terms. Where there is a conflict, the promotion terms will govern that promotion.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases, and to update that information promptly where necessary so that we can complete your transaction and contact you.

You confirm that the payment details you provide are true, correct and complete, that you are authorised to use the payment method concerned, and that you will pay the charges incurred at the prices posted, including delivery charges.

SECTION 6 - DELIVERY

Delivery timescales stated in our store are estimates and are not guaranteed. Made-to-order pieces may take longer, and we will contact you if we expect a significant delay.

Your order remains our responsibility until it is delivered to the address you have given us. Risk in the products passes to you on delivery.

Where delivery is delayed by an event outside our reasonable control, we will contact you as soon as possible to let you know. We will take steps to minimise the effect of the delay, and you may cancel your order and receive a refund for any products not yet dispatched.

If your parcel does not arrive, arrives incomplete, or appears to have been lost in transit, please contact us. Our Returns & Refunds policy sets out how we handle these situations.

SECTION 7 - RETURNS, CANCELLATION AND REFUNDS

Returns, cancellations and refunds are governed by our Returns & Refunds policy, which forms part of these Terms and should be read alongside them.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including all trade marks, brand names, text, displays, images, graphics, product photography, video and audio, and the design, selection and arrangement of them, are owned by anornament or its licensors and are protected by copyright, trade mark and other intellectual property laws in the United Kingdom and internationally.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store or transmit any of the material on the Services without our prior written consent. You must not reproduce our designs as physical articles, whether for sale or otherwise. Except as expressly provided in these Terms, nothing grants you a licence or other rights under any trade mark, copyright, design right or other intellectual property of anornament, Shopify or any third party. All rights not expressly granted are reserved.

The name anornament, together with our logos, product names, designs and slogans, are trade marks of anornament. You must not use them without our prior written permission. Shopify's name, logo, product and service names, designs and slogans are trade marks of Shopify. All other names, logos and marks appearing on the Services are the trade marks of their respective owners.

SECTION 9 - OPTIONAL TOOLS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control or input over.

You acknowledge that we provide access to such tools on an "as is" and "as available" basis, without warranties, representations or conditions of any kind and without endorsement. We have no liability arising from or relating to your use of optional third party tools, save to the extent that liability cannot lawfully be excluded.

Any use by you of the optional tools offered through the site is at your own discretion, and you should ensure you are familiar with and content with the terms on which those tools are provided by the relevant third party.

We may in future offer additional features through the Services. Such features will also form part of the Services and will be subject to these Terms of Service.

SECTION 10 - THIRD PARTY LINKS

The Services may contain material and hyperlinks relating to websites provided or operated by third parties, including embedded third party functionality. We are not responsible for examining or evaluating the content or accuracy of third party material or websites. If you choose to leave the Services to access such material or sites, you do so at your own risk.

We are not liable for any harm or loss relating to your access to third party websites, or your purchase or use of any products, services or content available on them, save to the extent that liability cannot lawfully be excluded. Please review the policies and practices of any third party before entering into a transaction with them. Complaints, claims or questions regarding third party products and services should be directed to the third party concerned.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

anornament is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with anornament. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and anornament, including any injury, damage or loss resulting from products purchased. You release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with anornament.

SECTION 12 - PRIVACY

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services will be transmitted to and shared with Shopify and with third parties who may be located in countries other than the one in which you reside, in order to provide the Services to you. Our Privacy Policy sets out in more detail how we, Shopify and our partners use your personal information, and the rights available to you under UK data protection law.

SECTION 13 - REVIEWS, FEEDBACK AND USER CONTENT

If you submit, upload, post, email or otherwise send us any ideas, suggestions, feedback, reviews, photographs, proposals or other content ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish, distribute and display that Feedback in any medium in connection with our business, including on our website and social media channels.

We will not use your Feedback in a way that identifies you beyond the name or username you supplied with it.

You confirm that you own or have all necessary rights to the Feedback you send, that you have disclosed any compensation or incentive received in connection with it, and that it complies with these Terms.

You agree that your Feedback will not infringe the rights of any third party, including copyright, trade mark, privacy or image rights, and will not be unlawful, defamatory, abusive, obscene or otherwise objectionable, and will not contain any virus or other malicious code. You may not use a false email address, impersonate any other person, or otherwise mislead us or others as to the origin of any Feedback. You are responsible for the Feedback you submit and its accuracy.

We are under no obligation to keep Feedback confidential, to pay compensation for it, or to respond to it. We may, but are not obliged to, monitor, edit or remove Feedback that we consider unlawful or otherwise objectionable, or that breaches these Terms.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information within the Services containing typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, delivery charges, transit times or availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information at any time without prior notice. Where a product has been listed at a price that is clearly incorrect, we may decline or cancel an affected order, including after it has been submitted, and will refund you in full rather than fulfil the order at the incorrect price.

SECTION 15 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: for any unlawful or malicious purpose; to breach any applicable law or regulation; to infringe our intellectual property rights or those of others; to harass, abuse, insult, defame, disparage or intimidate any person; to transmit false or misleading information; to send or procure the sending of unsolicited advertising or promotional material; to impersonate any person or entity; or to engage in any other conduct that restricts or inhibits anyone else's use of the Services, or which may harm anornament, Shopify or users of the Services.

In addition, you agree not to upload or transmit viruses or other malicious code; to reproduce, duplicate, copy, sell or resell any portion of the Services; to collect or track the personal information of others; to spam, phish, pretext, spider, crawl or scrape the Services; or to interfere with or circumvent the security features of the Services or any related website.

We reserve the right to suspend, restrict or terminate your access to the Services where we reasonably consider that you have breached this section.

SECTION 16 - SUSPENSION AND TERMINATION

We may suspend, withdraw or terminate all or part of the Services, or your access to them, where we reasonably consider it necessary, including where you have breached these Terms. Where we do so, we will give you notice unless the circumstances make that impractical.

Termination does not affect any order we have already accepted, or your rights in respect of products already purchased, and you will remain liable for any amounts due up to the date of termination.

The following sections continue to apply after termination: Intellectual Property, Reviews, Feedback and User Content, Suspension and Termination, Our Liability to You, Severability, Waiver and Entire Agreement, Assignment, Governing Law, and Privacy, together with any other provision which by its nature should survive.

SECTION 17 - OUR LIABILITY TO YOU

The information presented through the Services is made available for general information purposes. We do not warrant that it is complete, accurate or useful for any particular purpose, and any reliance you place on it is at your own risk, save in respect of product information forming part of your contract with us.

We do not guarantee that your use of the Services will be uninterrupted, timely, secure or free from error.

If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if at the time the contract was made both parties knew it might happen.

We are not responsible for loss or damage that is not foreseeable, or for delay or failure caused by an event outside our reasonable control.

We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any matter in respect of which your statutory rights as a consumer may not lawfully be excluded or restricted, including your rights in relation to products that are faulty, not as described, or not of satisfactory quality.

Subject to the paragraph above, our total liability to you in connection with any order is limited to the amount paid by you for that order.

We supply our products for domestic and private use. If you use our products for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption, or loss of business opportunity.

SECTION 18 - INDEMNITY

You agree to reimburse us for any loss, damage, liability or claim, including reasonable legal costs, that we suffer as a direct result of your deliberate breach of these Terms, your unlawful use of the Services, or your infringement of the rights of a third party.

We will notify you of any such claim within a reasonable time and will not settle it in a way that imposes obligations on you without your consent, which you will not unreasonably withhold. Nothing in this section applies to loss or claims arising from our own act or omission.

SECTION 19 - SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void or unenforceable, that provision will be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion will be treated as severed from these Terms. This will not affect the validity and enforceability of the remaining provisions.

SECTION 20 - WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of that right or provision, and does not prevent us from enforcing it later.

These Terms of Service, together with the policies referred to within them, constitute the entire agreement between you and us in relation to your use of the Services, and supersede any prior agreements, communications or proposals, whether oral or written, including any earlier version of these Terms.

SECTION 21 - ASSIGNMENT

You may not transfer or assign these Terms, or any of your rights or obligations under them, without our prior written consent. We may transfer our rights and obligations under these Terms to another business, and will tell you in writing if we do. Your rights under these Terms will not be affected.

SECTION 22 - GOVERNING LAW AND JURISDICTION

These Terms of Service, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the law of England and Wales.

You and we both agree that the courts of England and Wales will have jurisdiction over any such dispute or claim.

If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you live, and the mandatory consumer protection provisions of that country continue to apply to you. If you live in a country within the European Union, you retain the benefit of any mandatory consumer protection provisions of the country in which you are resident, and may bring proceedings in your local courts.

SECTION 23 - HEADINGS

The headings used in these Terms are included for convenience only and do not limit or otherwise affect these Terms.

SECTION 24 - CHANGES TO THESE TERMS

You can review the most current version of these Terms of Service at any time on this page. The version in force at the time you place an order is the version that applies to that order.

We reserve the right to update, change or replace any part of these Terms of Service by posting the updated version to our website. It is your responsibility to check this page periodically. Where a change is material, we will take reasonable steps to bring it to your attention. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.
